These Terms of Use (“Terms”) govern your access to and use of the CaseNX website and related online content (the “Site”). Use of CaseNX software products and services (the “Services”) is governed by separate written agreements with 292 Technologies, LLC (“CaseNX”).

1. Acceptance of Terms

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
If you use the Site on behalf of an organization, you represent that you have authority to bind that organization.

2. About CaseNX

CaseNX is a SaaS platform operated by 292 Technologies, LLC, providing mission-critical operational software for participants in the deathcare industry.

3. Demo scheduling and third-party tools

The Site may allow users to schedule demos using third-party tools such as Calendly. Information submitted through demo scheduling is governed by the Privacy Policy and the applicable third party’s policies.

4. Permitted use

You may use the Site solely for lawful, internal business evaluation purposes. You agree not to:

• Violate applicable laws or regulations
• Attempt unauthorized access to systems or data
• Interfere with Site security or operations
• Introduce malicious code or automated scraping tools

5. No compliance or legal guarantee

The Site and Services provide operational tools only. CaseNX does not provide legal, regulatory, medical, or compliance advice, and does not guarantee compliance with any federal, state, or local laws or regulations.Customers are solely responsible for understanding and complying with all laws governing their operations, including deathcare, vital records, transportation, licensing, and professional requirements.

6. Customer responsibility for data accuracy

You are solely responsible for the accuracy, completeness, and legality of all data and content submitted by you or on your behalf. CaseNX has no obligation to verify Customer Data and disclaims liability arising from inaccurate, incomplete, or improperly entered information.

7. Automated outputs and decision support

Certain features of the Services may include automated workflows, system-generated outputs, or operational suggestions. Such outputs are provided for informational and support purposes only and do not replace professional judgment, verification, or independent review.

8. Evolving and beta features

The Site and Services may be updated, modified, or enhanced over time. Certain features may be designated as beta or preview functionality and are provided “as is,” without guarantees regarding availability, accuracy, or continued support.

9. Intellectual property

All Site content, branding, and materials are owned by CaseNX or its licensors and are protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.

10. Feedback

Any feedback you submit may be used by CaseNX without restriction or compensation.

11. Third-party services

The Site and Services may rely on third-party platforms, infrastructure, or integrations. CaseNX is not responsible for the availability, performance, or security of third-party services and disclaims liability for outages, data loss, or interruptions caused by such services.

12. Force majeure

CaseNX shall not be liable for any delay or failure to perform resulting from events beyond its reasonable control, including acts of God, natural disasters, power or internet outages, labor disputes, acts of government, or failures of third-party service providers.

13. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

14. Limitation of liability

To the maximum extent permitted by law, CaseNX shall not be liable for indirect, incidental, special, or consequential damages. CaseNX’s total liability relating to the Site shall not exceed $100.

15. Indemnification

You agree to indemnify and hold harmless CaseNX and its affiliates from claims arising from your violation of these Terms or misuse of the Site.

16. Class action waiver

To the extent permitted by law, you agree that any disputes with CaseNX will be brought only on an individual basis and not as part of any class, collective, or representative action.

17. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction in those courts.

18. Changes to these Terms

We may update these Terms from time to time. Continued use of the Site constitutes acceptance of the revised Terms.
